These Terms of Service ("Terms") govern your use of the Night Light X mobile application (the "App") and the website at nightlightx.com (the "Site"), provided by Infinite Wave Media, LLC ("we", "us", or "our"). By using the App or Site, you agree to these Terms.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, solely for your personal, non-commercial use, and subject to these Terms and Apple's standard Licensed Application End User License Agreement.
2. In-App Purchases & Credits
The App is free to download and includes optional in-app purchases. Some features can also be unlocked using credits earned within the App. All purchases are final and non-refundable except as required by applicable law or by Apple's refund policies.
3. Acceptable Use
- You agree not to reverse engineer, decompile, or attempt to extract the source code of the App;
- You agree not to use the App for any unlawful purpose;
- You agree not to interfere with or disrupt the App, the Site, or our servers and networks;
- You agree not to attempt to gain unauthorized access to any part of the App or related systems.
4. Intellectual Property
The App, the Site, and all content, features, and functionality are the exclusive property of Infinite Wave Media, LLC and its licensors, and are protected by copyright, trademark, and other applicable laws.
5. Health & Safety Disclaimer
Night Light X is intended for relaxation and entertainment. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any sleep disorder or medical condition. If you have concerns about your sleep or health, consult a qualified medical professional. Use of bright or flashing colors may not be suitable for everyone, including individuals with photosensitive epilepsy; please use the App at a comfortable distance and brightness level.
6. Disclaimer of Warranties
The App and Site are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
To the maximum extent permitted by law, Infinite Wave Media, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App or Site.
8. Third-Party Services
The App and Site may link to or integrate with third-party services (such as Apple's App Store, ad networks, and our Tawk-hosted help center). We are not responsible for the content, policies, or practices of any third-party service.
9. Termination
We may suspend or terminate your access to the App or Site at any time, with or without notice, if we believe you have violated these Terms.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the App or Site after changes are posted constitutes your acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which Infinite Wave Media, LLC is established, without regard to its conflict of law principles.
